A former Boynton Beach cop who was fired after a pursuit led to the death of a 13-year old boy should get his job back.

An arbitrator has ruled in favor of Mark Sohn being reinstated without back pay.

He was fired in August of 2022, nine months after the death of Stanley Davis III, who was fleeing from a traffic stop on his dirt bike when he crashed.

Palm Beach County Police Benevolent Association President John Kazanjian tells CBS 12 News that the decision to fire Sohn was unjust.

"People who were driving dirt bikes unregistered, unlicensed up and down the streets. They were drag racing. So, Boynton Beach put a special overtime detail together and that's what he was working."

HP found that Sohn committed no crimes and said the teen was driving recklessly at over 80 miles per hour, but the Internal Affairs said the officer violated several policies.

The city has 90 days to make a decision.

The family of the teen is upset about the arbitrator's ruling. They were calling for his firing, nine months before it happened.

Here's a statement from the family of Stanley Davis III:

The family, community members, supporters & along with those seeking justice are extremely saddened, disappointed & outraged over the recent decision of the arbitrator in this important and highly significant, unfair death of our child, Stanley Davis III.

This decision to recommend Mark Sohn return to the department is an affront to justice and justice seekers in Boynton Beach and surrounding communities. It is yet another severe proverbial slap of injustice to the child victim(Stanley Davis III), our family & community. We are calling on the City of Boynton Beach to do what’s right and see this case to justice in every imaginable way.

We will not stand idly by and allow this egregious act of disregard and disrespect to be done to our family & the memory of our beloved Stanley Davis III, who was loved throughout the community. Our family won’t stop seeking justice until justice is duly served.
